Terms of Service
These Terms of Service (hereinafter the "Terms") govern access to and use of the service metallium.app (hereinafter the "Service"), operated by Metallium L.L.C., a Delaware (United States) limited liability company, EIN 38-4339357, with registered office at 1111B S Governors Ave, STE 25638, Dover, DE 19904, United States (hereinafter "Metallium", "we"). By creating an account or using the Service, you unconditionally accept these Terms.
1. Purpose
Metallium Studio is an online platform (SaaS) designed for live content creators. It offers a public profile, a creator directory, a partnership marketplace, and a set of live production tools ("Studio"): alerts, overlays, widgets, goals, chatbot, Song Requests, and the "Bridge" desktop application.
2. Access to the Service and Registration
2.1 Minimum age
The Service is strictly reserved for persons aged 18 and over. By registering, you declare that you are at least 18 years old.
2.2 Account
Access to features requires creating an account. You agree to provide accurate information and keep it up to date. You are responsible for the confidentiality of your credentials and any activity carried out from your account.
2.3 Third-party connections
Some features rely on connecting to third-party services (Google, Twitch, Spotify). You are responsible for complying with the terms of use of those services.
3. Plans and Pricing
The Service is offered in several plans. Current pricing is displayed on the Pricing page.

Prices are shown in euros, including any applicable taxes. Metallium reserves the right to change prices; any change will not affect already-paid subscription periods.
4. Subscriptions, Payment and Renewal
4.1 Payment
Payments are processed by our provider Stripe. No payment card data is stored by Metallium.
4.2 Renewal
Paid subscriptions are taken out on a monthly basis and automatically renewed at each billing date until cancelled.
4.3 Cancellation
You may cancel your subscription at any time from your account (Stripe Customer Portal). Cancellation takes effect at the end of the current subscription period; you retain access to paid features until that date.
5. Right of Withdrawal (EU consumers)
If you are a consumer residing in the European Union, you are in principle entitled to a withdrawal period of fourteen (14) days from the date of subscribing to a paid plan.
Waiver of the right of withdrawal: As the Service consists of the provision of digital content and online services whose performance begins immediately, you expressly acknowledge and agree at the time of subscription that: performance of the Service begins upon confirmation of your payment, with your prior and express consent; you accordingly waive your right of withdrawal once the Service is fully performed, or, for continuously executed services, to the extent already performed. Absent such waiver, the right of withdrawal applies under applicable law.
6. Refund Policy
Outside the statutory right of withdrawal described in Article 5, no refunds are granted, including on a pro-rata basis, for started subscription periods, unused features, or mid-period cancellations. These provisions apply without prejudice to mandatory consumer rights under the law of the user's country of residence.
7. User Obligations
You agree not to:
- use the Service for unlawful purposes or in breach of these Terms;
- post illegal, defamatory, hateful, misleading content or content infringing third-party rights;
- create fake accounts, impersonate others, or use unauthorised automated means;
- attempt to compromise the security or integrity of the Service;
- circumvent technical limitations or restrictions associated with your plan.
Metallium reserves the right to moderate, suspend or delete any content or account for breach, without notice in cases of serious breach.
8. User Content
You retain ownership of the content you post. You grant Metallium a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content solely for the purpose of providing and promoting the Service. You warrant that you hold the necessary rights over any content you post.
9. Bridge Desktop Application
The Bridge application is software installed on the user's device that enables local control of certain software (OBS, keyboard shortcuts). Its use is subject to these Terms. You are solely responsible for its installation and use on your hardware.
10. Availability and Evolution of the Service
The Service is provided "as is" and "as available". Metallium endeavours to maintain continuity of the Service but does not guarantee uninterrupted availability. The Service may be modified, suspended or interrupted for maintenance, updates, or any other legitimate reason. The Service depends on third-party providers (live platforms, authentication services, payments). Metallium shall not be liable for disruptions or changes attributable to those third parties.
11. Limitation of Liability
To the extent permitted by applicable law, Metallium shall not be liable for indirect damages, nor for amounts exceeding those actually paid by the user under their subscription in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits or excludes Metallium's liability where such limitation would be prohibited by mandatory applicable provisions, in particular those protecting consumers.
12. Suspension and Termination by Metallium
Metallium may suspend or terminate your access to the Service for breach of these Terms, fraud or misuse. No refund will be owed in the event of termination for serious breach.
13. Personal Data
The processing of your personal data is described in the Privacy Policy, which forms an integral part of these Terms.
14. Changes to the Terms
Metallium may update these Terms. Users will be notified of any material changes by an appropriate means. Continued use of the Service after the new Terms take effect constitutes acceptance.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware (United States). This does not affect the mandatory consumer-protection provisions of the user's country of residence within the European Union: if you are an EU consumer, you retain the protections afforded by the law of your country of residence and may bring proceedings before the competent courts of that country.
Mediation and online dispute resolution: in accordance with EU regulations, EU consumers may use the European Commission's online dispute-resolution platform where available.
